These Terms of Service ("Terms") govern your access to and use of glacemani.com (the "Site") and any purchase you make from us. The Site is operated by RKR Ventures Sdn. Bhd., trading as Glacé Mani ("Glacé," "we," "us," or "our").

By accessing the Site, placing an order, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or have the involvement of a parent/guardian, to place an order on the Site. By using the Site, you confirm that the information you provide is accurate and that you have the legal capacity to enter into a binding contract.

3. Products & Descriptions

All Glacé press-on nails are hand-painted and made to order. As each set is handmade, minor variations in design, colour, and finish between what's pictured and what you receive are normal and not considered defects.

We make reasonable efforts to display product colours, finishes, and sizing accurately, but we do not guarantee that your device's display will show colours exactly as they appear in person.

We reserve the right to limit quantities, discontinue products, or refuse any order at our discretion (e.g. suspected fraud, pricing errors, or stock issues), and will notify you and issue a refund if we cannot fulfil an order you've paid for.

4. Orders, Pricing & Payment

All prices are listed in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless stated otherwise.

We reserve the right to change prices, promotions, and product availability at any time without prior notice.

Payment is processed through third-party payment gateways, including HitPay, Atome & Grabpay. By placing an order, you agree to their applicable terms in addition to ours.

Checkout is currently available as guest checkout only - no account creation is required to place an order.

We reserve the right to cancel or refuse any order at our discretion, including where we suspect fraudulent activity, pricing/listing errors, or an inability to fulfil the order.

5. Shipping & Delivery

Orders are shipped within Malaysia only at this time. Shipping timeframes, fees, and courier details are set out in our Shipping & Returns Policy, which forms part of these Terms.

6. Returns & Exchanges

Because Glacé press-ons are hand-painted, made-to-order, and worn directly on the nails, they are a hygiene-sensitive product. Our returns, exchange, and refund terms are set out in full in our Shipping & Returns Policy, which forms part of these Terms.

7. Intellectual Property & Anti-Resale

All content on the Site - including our brand name, logo, product photography, nail designs, artwork, packaging, and website content - is owned by or licensed to RKR Ventures Sdn. Bhd. and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from our designs, photography, or branding without our prior written permission.

You may not purchase our products for the purpose of reselling, replicating, reverse-engineering, or manufacturing similar designs under another brand, nor use our product images or designs to market or sell competing products, without our prior written consent.

Personal, non-commercial use (e.g. sharing photos of your Glacé nails on social media, tagging us) is welcomed and encouraged.

We reserve the right to pursue legal action against any unauthorised commercial use, reproduction, or resale of our designs or branding.

8. User Conduct

When using the Site, you agree not to:

Use the Site for any unlawful purpose or in violation of these Terms
Attempt to gain unauthorised access to the Site, our systems, or other users' data
Interfere with or disrupt the Site's functionality or security
Submit false, misleading, or fraudulent information (including payment or shipping details)
Use automated means (bots, scrapers) to access or extract data from the Site without our permission

9. Reviews & User Content

If you submit reviews, photos, or other content to us (e.g. via email, social media, or the Site), you grant Glacé a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content for marketing and promotional purposes, including on the Site and social media. You confirm that you own or have the right to share any content you submit, and that it does not infringe any third party's rights.

10. Disclaimers

The Site and products are provided on an "as is" and "as available" basis. We make no warranties, express or implied, beyond those required by applicable Malaysian consumer protection law.

We are not liable for allergic reactions, skin irritation, or adhesive sensitivity resulting from product use. Please review product materials and, if you have known allergies or sensitivities, patch-test before full application or consult a dermatologist.

We do not guarantee the Site will be uninterrupted, error-free, or secure at all times.

11. Limitation of Liability

To the fullest extent permitted by Malaysian law, RKR Ventures Sdn. Bhd. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or products, including but not limited to loss of profits, data, or goodwill. Our total liability for any claim arising from your order shall not exceed the amount you paid for the relevant product.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Malaysian law (including the Consumer Protection Act 1999).

12. Indemnification

You agree to indemnify and hold harmless RKR Ventures Sdn. Bhd., its officers, employees, and affiliates from any claims, damages, losses, or expenses arising from your breach of these Terms or misuse of the Site.

13. Third-Party Links & Services

The Site may link to third-party websites, payment processors, or couriers (e.g. Ninja Van, HitPay). We are not responsible for the content, policies, or practices of third parties, and your use of their services is subject to their own terms.

14. Privacy

Your use of the Site is also governed by our [Privacy Policy], which explains how we collect, use, and protect your personal data, including for advertising and analytics purposes (Google Ads, Meta, TikTok).

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, products, or legal requirements (including as we expand to Singapore and Australia). The "Last updated" date at the top will reflect the most recent version. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

16. Termination

We reserve the right to suspend or terminate your access to the Site at our discretion, including for suspected violation of these Terms, without prior notice.

17. Governing Law & Disputes

These Terms are governed by the laws of Malaysia. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Malaysia.
